These Terms of Service constitute a legally binding agreement between you and WebpageIQ LLC, a Nebraska limited liability company (“WebpageIQ,” “we,” “us,” or “our”).
These Terms govern your access to and use of:
- webpageiq.com;
- The WebpageIQ account portal;
- The WebpageIQ website builder;
- The WebpageIQ content-management system;
- Websites created, hosted, published, or managed through WebpageIQ;
- WebpageIQ analytics and website-intelligence features;
- WebpageIQ forms and form-management features;
- WebpageIQ billing and subscription services;
- WebpageIQ application programming interfaces;
- WebpageIQ support and assisted website services; and
- Any other products, software, features, or services that link to these Terms.
These products and services are collectively referred to as the “Services.”
By creating an account, checking a box indicating your acceptance, purchasing a subscription, accessing the Services, or continuing to use the Services after being notified of updated Terms, you agree to these Terms and the WebpageIQ Privacy Policy.
If you do not agree, you may not create an account, purchase a subscription, or use the Services.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding contract to create a WebpageIQ account or purchase the Services.
If you use the Services on behalf of a business, organization, nonprofit, partnership, corporation, limited liability company, or other entity, you represent and warrant that:
- You have authority to bind that entity;
- The entity accepts these Terms;
- The information you provide about the entity is accurate;
- Your use of the Services is within the scope of your authority; and
- You are responsible for activities performed through the account.
In these circumstances, “you” and “your” refer to both the individual accepting these Terms and the entity on whose behalf the individual acts.
You may not use the Services if:
- You are legally prohibited from receiving them;
- You previously had an account terminated for material violations and WebpageIQ has not authorized your return;
- You are located in a jurisdiction where providing the Services would violate applicable law; or
- You are attempting to use the Services for an unlawful or prohibited purpose.
2. Accounts
Account registration
You must provide complete, accurate, and current information when creating and maintaining an account.
You must promptly update your information when it changes.
You may not:
- Create an account using false information;
- Impersonate another person or entity;
- Create an account for someone else without authority;
- Use an email address you do not control;
- Transfer your account without WebpageIQ’s authorization;
- Share credentials with unauthorized persons; or
- Attempt to conceal the identity of the person or entity responsible for an account.
Account security
You are responsible for:
- Maintaining the confidentiality of your password and authentication credentials;
- Limiting access to your account;
- Using reasonable security practices;
- Reviewing users authorized to manage your websites;
- Protecting recovery codes and two-factor authentication methods; and
- Promptly notifying WebpageIQ of suspected unauthorized access.
You are responsible for actions taken through your account unless caused directly by WebpageIQ’s failure to use reasonable security measures.
WebpageIQ may require:
- Email verification;
- Identity confirmation;
- Multi-factor authentication;
- Password changes;
- Reauthentication;
- Additional security information; or
- Other reasonable measures to protect an account or the Services.
Authorized users
You may allow authorized employees, contractors, representatives, or agents to access websites or account functions made available through the Services.
You are responsible for:
- Determining who should receive access;
- Assigning appropriate permissions;
- Removing access when it is no longer needed;
- Ensuring authorized users comply with these Terms; and
- Activities performed by authorized users acting through your account.
3. Description of the Services
WebpageIQ provides tools and services that may allow customers to:
- Create a website through a guided website builder;
- Generate website structures and content;
- Upload and organize images and media;
- Edit website pages, navigation, forms, and footers;
- Preview a website;
- Publish a website;
- Connect a custom domain;
- Host and deliver website content;
- Collect visitor form submissions;
- Review website analytics;
- View website-performance information;
- Receive automated website recommendations;
- Preview proposed website changes;
- Approve or reject recommendations;
- Measure visitor activity after changes;
- Manage subscriptions and billing; and
- Request assistance from WebpageIQ.
Features vary by plan, account status, website status, location, and product availability.
Descriptions on pricing pages, checkout screens, promotional materials, and product interfaces are incorporated into these Terms for the applicable transaction.
WebpageIQ may add, modify, limit, replace, or discontinue features as described in these Terms.
4. Preview Service
WebpageIQ may offer a free website-preview period.
Unless a different period is clearly disclosed when the preview begins, the preview period lasts 14 days.
A preview may include access to:
- A temporary staging website;
- Website editing;
- Pages and forms;
- Website customization;
- Uploaded media;
- Search-engine configuration preparation; and
- Other preview features made available by WebpageIQ.
Preview websites may be subject to limitations, including:
- No custom domain;
- No public search-engine indexing;
- Limited or unavailable analytics;
- Limited or unavailable Intelligence features;
- Feature, page, form, or storage limits;
- Temporary website addresses;
- Reduced support; and
- Automatic expiration.
No payment method is required unless otherwise clearly disclosed.
Preview expiration
At the end of the preview period, WebpageIQ may:
- Disable access to the public preview;
- Suspend the website;
- Restrict editing or publishing;
- Preserve the website temporarily for possible activation;
- Send reminders concerning expiration;
- Remove hosting or delivery resources; or
- Delete the preview and associated information after a reasonable period.
WebpageIQ is not required to preserve an expired preview indefinitely.
You are responsible for activating a paid plan before expiration if you want the website to remain available.
A preview is not a promise that WebpageIQ will permanently host, retain, publish, or maintain the website without a paid subscription.
5. Subscription Plans
WebpageIQ may offer plans including Preview, Launch, Intelligence, Pilot, Founding, promotional, legacy, or other plans.
The current features, prices, billing periods, and limits of publicly available plans are displayed through the Services or during checkout.
Launch
The Launch plan may include:
- Permanent website hosting while the subscription remains active;
- Custom domain connection;
- HTTPS;
- Content-delivery services;
- Search-ready publishing;
- Basic website analytics;
- Limited analytics history; and
- Other features identified on the applicable pricing page.
Intelligence
The Intelligence plan may include Launch features plus:
- Website recommendations based on visitor behavior;
- Page, call-to-action, navigation, and conversion insights;
- Search-engine optimization opportunities;
- Previews of recommended updates;
- Recommendation approval or rejection;
- Measurement of approved changes;
- Extended analytics history; and
- Other Intelligence features identified on the applicable pricing page.
Pilot, Founding, promotional, and legacy plans
Pilot, Founding, promotional, complimentary, discounted, or legacy plans may have special:
- Pricing;
- Eligibility requirements;
- Features;
- restrictions;
- Renewal terms;
- Duration;
- Benefits; or
- Conditions.
These plans are governed by the terms disclosed when offered, any written agreement between you and WebpageIQ, and these Terms.
Unless expressly stated otherwise, promotional eligibility is determined by WebpageIQ and may be limited by:
- Account;
- Customer;
- Website;
- Subscription history;
- Plan history;
- Redemption history;
- Geographic location;
- Offer dates; or
- Other reasonable criteria.
Promotions:
- Have no cash value;
- May not be transferred;
- May not be combined unless expressly allowed;
- May be withdrawn before acceptance;
- May be corrected if issued or applied in error; and
- May be subject to expiration.
Plan limits
Plans may include limits on:
- Number of websites;
- Number of pages;
- Number of forms;
- Number of form submissions;
- Number or size of uploaded files;
- Storage;
- Bandwidth;
- Analytics history;
- User seats;
- Domains;
- Recommendations;
- Artificial-intelligence usage;
- Publishing activity;
- Support; or
- Other resources.
Current limits may be displayed through the Services.
WebpageIQ may enforce limits technically or require you to upgrade, reduce usage, or pay additional charges before exceeding them.
6. Subscription Billing and Automatic Renewal
Recurring subscription authorization
Paid WebpageIQ plans are recurring subscriptions unless expressly identified as one-time purchases.
By starting a paid subscription, you authorize WebpageIQ and its payment processor to charge the payment method associated with your account:
- The price displayed at checkout;
- Applicable taxes;
- Any separately authorized charges;
- On the billing schedule disclosed at checkout;
- Until the subscription is canceled or otherwise terminated.
Monthly subscriptions automatically renew for successive monthly billing periods unless canceled before the next renewal date.
Any longer billing term automatically renews for successive periods of the same duration unless otherwise disclosed.
The checkout process will disclose the material terms of the subscription before you submit payment information, including:
- The plan selected;
- The amount charged;
- The billing frequency;
- Whether a promotional rate applies;
- When promotional pricing ends, if applicable; and
- How the subscription may be canceled.
Payment processor
Payments are processed by Stripe or another payment processor selected by WebpageIQ.
Your use of payment-processing services may also be governed by the processor’s terms and privacy policy.
WebpageIQ does not ordinarily receive or store complete payment-card numbers or card security codes.
You authorize the payment processor to:
- Store your payment method;
- Charge recurring subscription fees;
- Update stored card details through supported account-updater services;
- Process refunds or credits;
- Retry failed charges; and
- Perform fraud-prevention and transaction-verification activities.
Prices
Prices are stated in U.S. dollars unless otherwise specified.
You are responsible for:
- Subscription fees;
- Domain-related fees;
- Approved service charges;
- Applicable sales, use, excise, value-added, or similar taxes; and
- Charges resulting from your authorized use of the Services.
WebpageIQ may change prices prospectively.
For an existing recurring subscription, WebpageIQ will provide advance notice when legally required before a price increase takes effect.
Continuing the subscription after the effective date of a properly disclosed price change constitutes acceptance of the new price.
Taxes
Displayed prices may not include taxes.
WebpageIQ or its payment processor may calculate and collect taxes where required.
You are responsible for taxes not collected by WebpageIQ, excluding taxes based on WebpageIQ’s net income.
Failed payments
If a payment fails, WebpageIQ or its payment processor may:
- Retry the payment;
- Ask you to update your payment method;
- Restrict billing features;
- Mark the subscription past due;
- Suspend or limit the website;
- Remove public hosting after the applicable billing period or grace period;
- Cancel the subscription; or
- Take reasonable collection action.
WebpageIQ may continue providing limited access during a payment-retry or grace period, but is not required to do so.
You remain responsible for valid unpaid charges incurred before cancellation or suspension.
Billing disputes
You must notify WebpageIQ promptly if you believe a charge is incorrect.
Contact:
Include:
- Your account email;
- The website involved;
- The charge date;
- The amount;
- The reason for the dispute; and
- Supporting information.
Initiating a payment dispute or chargeback does not automatically cancel a subscription.
WebpageIQ may suspend affected Services while a payment dispute is investigated.
7. Upgrades, Downgrades, and Plan Changes
Upgrades
An upgrade may take effect immediately.
When an upgrade takes effect immediately:
- New features may become available immediately;
- WebpageIQ or Stripe may calculate a prorated charge or credit;
- The billing amount or billing cycle may change; and
- Promotional eligibility may be recalculated.
The applicable amount will be disclosed before confirmation when required.
Downgrades
A downgrade may be scheduled to take effect at the end of the current paid billing period.
Until the effective date:
- The existing plan may remain active;
- Existing charges generally remain due;
- Higher-tier features may remain available; and
- You may be able to cancel the scheduled downgrade where supported.
When a downgrade becomes effective:
- Higher-tier features may become unavailable;
- Analytics history may become limited;
- Recommendations may become unavailable;
- Page, form, storage, or feature limits may change; and
- Content exceeding the new limits may become inaccessible or require modification.
WebpageIQ will not intentionally delete excess content immediately solely because of a downgrade unless necessary to operate the Service, enforce reasonable limits, or comply with law. Continued excess usage may require an upgrade or removal of content.
Plan corrections
WebpageIQ may correct a plan assignment, promotion, credit, or subscription status that resulted from:
- Technical error;
- Duplicate checkout;
- Failed payment;
- Fraud;
- Unauthorized activity;
- Incorrect eligibility;
- Pricing-display error; or
- Payment-processor inconsistency.
When reasonably possible, WebpageIQ will notify you of a material correction.
8. Cancellation
You may cancel a recurring subscription through the billing controls provided in your WebpageIQ account.
If account cancellation controls are temporarily unavailable, you may request cancellation by emailing:
Your request should identify:
- Your account email;
- The website involved; and
- The subscription you wish to cancel.
WebpageIQ may reasonably verify your identity and authority before processing an emailed cancellation request.
Effect of cancellation
Unless otherwise disclosed:
- Cancellation stops future automatic renewals;
- The subscription remains active until the end of the current paid billing period;
- Existing fees are not prorated merely because you stop using the Services;
- You retain access to paid features through the end of the period, subject to these Terms;
- The website may be suspended after the paid period ends; and
- Hosting and delivery resources may be removed after suspension.
Cancellation does not erase charges already incurred.
Canceling one website subscription does not necessarily cancel:
- Other website subscriptions;
- Domain registrations;
- Separate professional services;
- Outstanding invoices; or
- Other purchases.
Resuming cancellation
Where supported, you may resume a subscription scheduled for cancellation before the current billing period ends.
Resuming cancellation may restore automatic renewal under the pricing and plan terms then applicable.
9. Refunds and Credits
Except where required by law or expressly stated in a written offer:
- Subscription payments are nonrefundable after the applicable paid period begins;
- Partial months are not prorated after cancellation;
- Unused time has no cash value;
- Credits and promotions are nonrefundable;
- Domain-related charges are nonrefundable once incurred;
- Completed professional-service work is nonrefundable; and
- Charges for approved custom work remain due.
WebpageIQ may issue a refund or service credit at its discretion.
A discretionary refund or credit:
- Does not create an obligation to issue future refunds;
- Does not modify these Terms; and
- May be conditioned on resolution of the underlying issue.
Nothing in this section limits nonwaivable refund rights provided by applicable law.
10. Suspension, Deactivation, and Termination
Suspension by WebpageIQ
WebpageIQ may suspend, restrict, unpublish, deactivate, or disable any account, website, domain connection, form, submission endpoint, feature, or content when reasonably necessary because of:
- Nonpayment;
- Expired preview status;
- Violation of these Terms;
- Illegal activity;
- Security risk;
- Fraud or suspected fraud;
- Spam or abuse;
- Malware or malicious code;
- Excessive resource consumption;
- Threats to platform stability;
- Copyright or intellectual-property complaints;
- Privacy or data-protection risk;
- Court order or governmental request;
- Risk to customers, visitors, WebpageIQ, or third parties;
- Abandoned or inactive accounts;
- Emergency maintenance; or
- Conduct likely to expose WebpageIQ to liability.
Where reasonably possible, WebpageIQ will provide notice and an opportunity to correct the issue.
WebpageIQ may act without advance notice when immediate action is reasonably necessary to prevent harm, comply with law, protect security, or preserve the Services.
Effect of suspension
Suspension may result in:
- The website becoming unavailable;
- Forms ceasing to accept submissions;
- Custom domains no longer displaying the website;
- Loss of editing or publishing access;
- Analytics collection stopping;
- Recommendations becoming unavailable;
- Restricted access to stored content;
- Removal of content-delivery resources; or
- Other limitations.
Suspension does not automatically eliminate unpaid fees or other obligations.
Termination by WebpageIQ
WebpageIQ may terminate an account or subscription for:
- Material or repeated violations;
- Fraudulent or unlawful use;
- Repeated infringement;
- Serious security abuse;
- Nonpayment;
- Attempts to damage or disrupt the Services;
- Use that creates unacceptable legal or operational risk; or
- Any reason where termination is permitted under these Terms and applicable law.
For termination unrelated to your breach, WebpageIQ may provide a prorated refund for prepaid unused subscription time where appropriate.
No refund is required when termination results from your material breach, illegal activity, fraud, abuse, or nonpayment, except where required by law.
11. Website Reactivation
A suspended website may be eligible for reactivation.
Reactivation may require:
- Selecting an available subscription plan;
- Paying outstanding balances;
- Updating payment information;
- Recreating hosting resources;
- Reconnecting a domain;
- Republishing website content;
- Correcting a Terms violation; or
- Completing security verification.
WebpageIQ does not guarantee that every suspended website can be restored.
Certain information, analytics, media, domains, integrations, or historical configurations may no longer be available after extended suspension.
12. Account and Website Deletion
You may request account deletion by emailing:
The request should be sent from the email address associated with the account whenever possible and should include:
- Your name;
- Your account email;
- The website or websites involved; and
- A clear request to delete the account.
WebpageIQ may verify your identity and authority before processing deletion.
Deleting an account may permanently delete or disable:
- Your account;
- Your websites;
- Published website content;
- Website drafts;
- Uploaded media;
- Forms;
- Form submissions;
- Website settings;
- Analytics;
- Recommendations;
- Domain connections; and
- Other account information.
Before deletion, you are responsible for exporting any content or information you wish to retain.
WebpageIQ may retain limited information where reasonably necessary for:
- Billing;
- Taxes;
- Accounting;
- Fraud prevention;
- Security;
- Dispute resolution;
- Contract enforcement;
- Legal compliance;
- Legal claims;
- Documentation of the deletion request; or
- Backup rotation.
Deletion does not remove information already:
- Sent to form recipients;
- Exported by you;
- Copied by authorized users;
- Retained by payment processors;
- Published or copied by third parties; or
- Lawfully retained outside WebpageIQ.

13. Domains
Custom domain connection
Paid plans may permit you to connect a custom domain.
You are responsible for ensuring that:
- You own or control the domain;
- You have authority to modify its DNS settings;
- The domain does not infringe another person’s rights;
- Registration information is accurate;
- Renewal fees are paid;
- The domain remains in good standing; and
- Use of the domain complies with law.
Customer-owned domains
When a domain is registered in your name or your registrar account, you retain ownership subject to the registrar’s terms.
You are responsible for:
- Renewal;
- Contact information;
- Registrar security;
- Transfer codes;
- Registry rules;
- Disputes; and
- Fees.
WebpageIQ is not responsible for loss of a domain caused by:
- Failure to renew;
- Incorrect contact information;
- Registrar action;
- Registry action;
- Domain dispute;
- Account compromise;
- Expired payment method; or
- Your failure to respond to notices.
WebpageIQ-managed domains
WebpageIQ may assist with registering, connecting, renewing, or managing a domain.
Unless expressly included in a written offer:
- Domain registration is separate from the monthly WebpageIQ subscription;
- Registration and renewal fees may be charged separately;
- Registry and registrar rules apply;
- Registration is subject to availability; and
- WebpageIQ does not guarantee acquisition of a requested domain.
When WebpageIQ registers or manages a domain for you, WebpageIQ acts as an administrative or technical service provider. Beneficial ownership remains subject to the applicable agreement, payment status, registrar records, and domain-registration arrangement.
You must reimburse WebpageIQ for authorized domain expenses.
WebpageIQ may decline to renew or manage a domain after providing reasonable notice.
Domain transfers
Domain transfers may require:
- Identity verification;
- Payment of outstanding charges;
- Registrar unlock procedures;
- Transfer codes;
- Waiting periods imposed by registrars or registries;
- Updated ownership information; and
- Compliance with applicable transfer policies.
WebpageIQ may refuse a transfer request that is fraudulent, unauthorized, legally prohibited, technically impossible, or subject to an unresolved ownership dispute.
WebpageIQ will not hold a customer-owned domain solely to force continued use of the Services.
Subdomains and temporary addresses
WebpageIQ subdomains, preview URLs, and platform-owned addresses remain the property of WebpageIQ.
You receive a limited, revocable right to use an assigned address while eligible.
WebpageIQ may change, suspend, or withdraw a platform-owned address when reasonably necessary.
14. Customer Content
“Customer Content” means content that you or your authorized users upload, enter, create, submit, import, publish, transmit, or otherwise provide through the Services, including:
- Text;
- Images;
- Logos;
- Videos;
- Audio;
- Documents;
- Business information;
- Product and service descriptions;
- Form configurations;
- External links;
- Customer lists;
- Instructions;
- Website designs;
- Reviews or testimonials;
- Data;
- Code; and
- Other materials.
Ownership
As between you and WebpageIQ, you retain ownership of your Customer Content, subject to:
- Rights belonging to third parties;
- Licenses contained in these Terms;
- WebpageIQ’s ownership of the Services;
- Rights in WebpageIQ templates, software, systems, and technology; and
- Any separate written agreement.
Using WebpageIQ does not transfer ownership of your independent Customer Content to WebpageIQ.
License to WebpageIQ
You grant WebpageIQ a worldwide, nonexclusive, royalty-free, sublicensable license to:
- Host;
- Store;
- Copy;
- Reproduce;
- Modify;
- Format;
- Resize;
- Compress;
- Convert;
- Analyze;
- Process;
- Transmit;
- Publish;
- Display;
- Distribute; and
- Create technical or functional adaptations of Customer Content
only as reasonably necessary to:
- Provide the Services;
- Build and publish your website;
- Process media;
- Generate website content or recommendations;
- Provide analytics;
- Deliver form submissions;
- Secure the Services;
- Troubleshoot issues;
- Comply with your instructions;
- Enforce these Terms; or
- Comply with law.
This license continues for as long as Customer Content remains in the Services and for a reasonable period afterward as necessary for backups, legal compliance, dispute resolution, or normal deletion processes.
Customer Content warranties
You represent and warrant that:
- You own Customer Content or have all permissions necessary to use it;
- You have authority to grant the license in these Terms;
- Customer Content does not infringe copyright, trademark, privacy, publicity, contractual, or other rights;
- Your use of Customer Content is lawful;
- Required consents and releases have been obtained;
- Testimonials and reviews are genuine and lawfully used;
- Claims in Customer Content are truthful and not misleading;
- Customer Content complies with advertising and industry rules applicable to your business; and
- Customer Content does not violate these Terms.
Customer responsibility
You are solely responsible for reviewing Customer Content before publication.
WebpageIQ does not assume responsibility for:
- Accuracy;
- Completeness;
- Legality;
- Required disclosures;
- Licensing;
- Regulatory compliance;
- Advertising claims;
- Professional claims;
- Pricing;
- Offers;
- Guarantees;
- Accessibility compliance;
- Industry-specific requirements; or
- Third-party rights associated with Customer Content.
WebpageIQ’s assistance with creating, editing, optimizing, or publishing content does not shift responsibility for the final website away from you.
15. WebpageIQ Content and Intellectual Property
The Services, excluding Customer Content, are owned by WebpageIQ or its licensors.
Protected WebpageIQ materials may include:
- Software;
- Source code;
- Object code;
- Website-builder systems;
- Analytics systems;
- Intelligence systems;
- Recommendation logic;
- Algorithms;
- Models;
- Databases;
- User interfaces;
- Templates;
- Components;
- Designs;
- Graphics;
- Documentation;
- Branding;
- Logos;
- Text;
- Workflows;
- Reports;
- Compilation and arrangement of content; and
- Other technology and materials.
These Terms do not transfer ownership of WebpageIQ intellectual property to you.
Subject to your compliance with these Terms, WebpageIQ grants you a limited, nonexclusive, nontransferable, nonsublicensable, revocable right to access and use the Services during the applicable subscription or preview period.
You may not:
- Copy or reproduce the Services except as authorized;
- Sell, rent, lease, sublicense, or redistribute the Services;
- Reverse engineer, decompile, or disassemble the Services except where the restriction is prohibited by law;
- Attempt to discover source code or nonpublic algorithms;
- Circumvent feature restrictions or access controls;
- Remove proprietary notices;
- Use WebpageIQ branding without permission;
- Frame or mirror the Services;
- Create a competing product using nonpublic aspects of the Services;
- Scrape the Services in a manner that burdens or damages them;
- Use automated means to extract protected platform content;
- Benchmark the Services for publication without authorization where prohibited by law; or
- Misrepresent your relationship with WebpageIQ.
16. Generated and Assisted Content
WebpageIQ may generate or assist with:
- Website copy;
- Page structures;
- Search-engine metadata;
- Calls to action;
- Images or image selections;
- Recommendations;
- Performance explanations;
- Form classifications;
- Industry descriptions;
- Design suggestions; and
- Other content.
Generated or assisted content may be produced using automated systems, templates, statistical methods, or artificial intelligence.
You acknowledge that generated content may:
- Be inaccurate;
- Be incomplete;
- Contain errors;
- Resemble content generated for another user;
- Require factual verification;
- Require legal or regulatory review;
- Require permission from a rights holder;
- Be unsuitable for your business;
- Fail to satisfy accessibility requirements; or
- Produce unexpected results.
You are responsible for reviewing, editing, approving, and lawfully using generated content before publication.
WebpageIQ does not guarantee that generated content:
- Is unique;
- Is copyrightable;
- Does not resemble third-party content;
- Is legally compliant;
- Is factually correct;
- Will rank in search engines;
- Will produce sales;
- Will create customers; or
- Is suitable for professional, medical, legal, financial, or other regulated advice.
17. Website Analytics
WebpageIQ may collect and process visitor-interaction information from websites powered by WebpageIQ.
Analytics may include:
- Pageviews;
- Sessions;
- Scroll depth;
- Active time;
- Idle time;
- Navigation;
- Link and button interactions;
- Block impressions;

WebpageIQ does not guarantee that analytics will match:
- Server logs;
- Advertising platforms;
- Search-engine platforms;
- Other analytics providers;
- Sales records;
- Customer relationship management systems; or
- Financial records.
You must not treat WebpageIQ analytics as audited financial, accounting, scientific, or regulatory records.
18. Intelligence Recommendations and Results
WebpageIQ Intelligence may analyze visitor behavior and recommend website changes.
Recommendations may concern:
- Calls to action;
- Navigation;
- Page structure;
- Content placement;
- Next-step guidance;
- Page sections;
- Search-engine opportunities;
- Forms;
- Visitor engagement; or
- Other website elements.
No guaranteed outcome
WebpageIQ does not guarantee that:
- A recommendation will improve performance;
- A website change will increase sales;
- A website will generate leads;
- A website will rank in search results;
- Visitor engagement will improve;
- A measured result is statistically conclusive;
- A recommendation is suitable for every visitor;
- A result will continue over time; or
- Intelligence will identify every possible issue.
Results may be affected by:
- Low visitor volume;
- Seasonal changes;
- Advertising activity;
- Market conditions;
- Changes made outside WebpageIQ;
- Returning visitors;
- Customer behavior;
- External events;
- Website outages;
- Tracking limitations;
- Statistical variation; or
- Other factors.
Labels such as “early positive signal,” “insufficient data,” “negative result,” “active measurement,” or similar descriptions are informational estimates and not guarantees.
Customer approval
Where the Services request approval, you control whether a recommendation is:
- Approved;
- Rejected;
- Ignored;
- Reversed; or
- Left pending.
By approving a recommendation, you authorize WebpageIQ to modify and publish the affected Customer Content or website configuration.
You remain responsible for reviewing the resulting website and confirming that it accurately represents your business.
Interrupted or invalid measurements
A measurement may be interrupted, restarted, invalidated, or marked inconclusive if:
- The affected content changes;
- A website version changes;
- Tracking becomes unavailable;
- Visitor volume is insufficient;
- A recommendation is reversed;
- The website is suspended;
- Data quality is inadequate; or
- Another event prevents a meaningful comparison.
19. Forms and Visitor Information
Customers may create forms that collect information from website visitors.
You are responsible for:
- Selecting lawful form fields;
- Requesting only information reasonably needed;
- Providing required notices;
- Obtaining required consent;
- Identifying appropriate recipients;
- Protecting form submissions;
- Responding to visitors;
- Deleting submissions no longer needed;
- Complying with marketing and communications laws;
- Handling exported information securely; and
- Complying with industry-specific obligations.
You may not use WebpageIQ forms to unlawfully collect:
- Social Security numbers;
- Passwords;
- Complete payment-card information;
- Bank-account credentials;
- Government identification;
- Medical records;
- Genetic information;
- Biometric identifiers;
- Information from children;
- Sensitive personal information; or
- Other regulated information.
Limited collection of sensitive information is permitted only when:
- It is lawful;
- It is necessary for a legitimate purpose;
- WebpageIQ has not prohibited the use;
- Required notices and consents are provided;
- Appropriate safeguards are implemented; and
- Any specialized agreement required by WebpageIQ has been completed.
WebpageIQ is not a healthcare clearinghouse, health plan, or healthcare provider and does not represent that the Services are configured for compliance with the Health Insurance Portability and Accountability Act.
You may not use the Services to store or transmit protected health information unless WebpageIQ expressly agrees in writing and any required business associate agreement is executed.
WebpageIQ may automatically evaluate form submissions for spam, fraud, abuse, or technical errors.
Spam classification is not guaranteed to be accurate. You are responsible for reviewing submissions before relying on or discarding them.
20. Privacy and Legal Compliance
Your use of the Services must comply with:
- Privacy laws;
- Data-protection laws;

- Electronic-communications laws;

- Industry regulations;
- Accessibility requirements;
- Intellectual-property laws;
- Tax requirements; and
- Other laws applicable to your business and website.
You are responsible for determining whether your website requires:

- Accessibility accommodations;
- Industry disclosures;
- Terms and conditions;
- Refund terms;
- Age restrictions;
- Licenses;
- Permits; or
- Other notices.
A WebpageIQ Privacy Policy link does not replace a customer-specific privacy notice when your independent activities require one.
WebpageIQ does not provide legal, tax, accounting, medical, financial, accessibility, or regulatory advice.
21. Electronic Communications
You consent to receive electronic communications from WebpageIQ concerning:
- Your account;
- Security;
- Authentication;
- Billing;
- Payments;
- Subscriptions;
- Website status;
- Service changes;
- Legal notices;
- Support;
- Recommendations;
- Performance reports; and
- Other matters related to the Services.
Electronic communications may be delivered through:
- Email;
- Account notices;
- Website banners;
- Billing interfaces;
- In-product messages; or
- Other electronic means.
You are responsible for maintaining a current email address and reviewing communications sent to it.
A communication is considered received when sent to the email address associated with your account or displayed through the Services, subject to applicable law.
You may unsubscribe from nonessential marketing communications. You cannot opt out of communications necessary to operate, secure, bill, or administer your account.
22. Professional and Assisted Services
WebpageIQ may provide optional assisted services, including:

- Migration; or
- Other custom work.
Assisted services may be governed by:

- Invoice;

Unless expressly stated otherwise:
- Work outside the included scope is billed at WebpageIQ’s current service rate;
- Estimates are not guarantees of final cost;
- Additional work requires your authorization;
- Delays caused by missing information extend delivery;
- You are responsible for supplying accurate content;
- You are responsible for reviewing and approving work;
- Included revisions are limited to the number stated in the offer;
- Additional revisions may be billed separately; and
- Subscription fees are separate from custom-service fees.
Complimentary website builds
A complimentary or free website build may be subject to:
- Eligibility criteria;
- A required subscription;
- Limited pages or content;
- A limited number of revisions;
- A deadline for providing information;
- Exclusion of domains and third-party costs;
- Additional charges for later changes; and
- Other offer-specific conditions.
“Free website build” does not mean that:
- The subscription is free;
- Domain registration is free;
- Unlimited revisions are included;
- Future editing by WebpageIQ is included;
- Custom development is included;
- Third-party services are included; or
- You own WebpageIQ software or templates.
After publication, you may edit eligible content through the Services. Work you ask WebpageIQ to perform after the included scope may be billed at the then-current rate disclosed before the work is performed.
23. Acceptable Use
You may use the Services only for lawful purposes.
You may not use the Services to:
- Violate any law or regulation;
- Commit fraud;
- Impersonate another person;
- Mislead consumers;
- Infringe intellectual-property rights;
- Violate privacy or publicity rights;
- Publish defamatory content;
- Harass, threaten, or exploit others;
- Promote violence or unlawful discrimination;
- Distribute malware;
- Conduct phishing;
- Steal credentials;
- Facilitate unauthorized surveillance;
- Send spam;
- Operate an unlawful pyramid or investment scheme;
- Sell illegal products or services;
- Facilitate human trafficking;
- Distribute child sexual abuse material;
- Sexually exploit minors;
- Collect unlawful information from children;
- Host nonconsensual intimate imagery;
- Circumvent security controls;
- Attack or disrupt systems;
- Probe vulnerabilities without authorization;
- Overload infrastructure;
- Automate abusive requests;
- Manipulate analytics;
- Falsify form submissions;
- Interfere with another customer;
- Use the Services to train a competing platform through unauthorized extraction;
- Resell the Services without authorization; or
- Encourage another person to do any prohibited act.
WebpageIQ may investigate suspected violations and cooperate with lawful investigations.
24. Regulated and High-Risk Activities
You may not use the Services for a regulated or high-risk activity unless:
- The activity is lawful;
- You hold all required licenses;
- Your use complies with applicable regulations;
- The Services are suitable for the activity;
- You have obtained WebpageIQ’s written approval where requested; and
- Any additional agreement required by WebpageIQ is in place.
High-risk activities may include:
- Healthcare;
- Financial services;
- Lending;
- Insurance underwriting;
- Employment screening;
- Housing eligibility;
- Education admissions;
- Legal services;
- Gambling;
- Controlled substances;
- Weapons;
- Adult services;
- Government services;
- Emergency services; or
- Decisions producing legal or similarly significant effects.
The Services are not designed as emergency systems, life-safety systems, or legally mandated recordkeeping systems.
You may not rely on WebpageIQ for emergency communications or situations where failure could cause death, bodily injury, or severe property damage.
25. Third-Party Services
The Services may interact with independent third parties, including:
- Stripe;
- Google;
- Domain registrars;
- DNS providers;
- Content-delivery networks;
- Email-delivery providers;
- Hosting providers;
- Maps;
- Video platforms;
- Social networks;
- Booking systems;
- Donation services;
- Payment links;
- External forms; and
- Other integrations.
Third-party services are governed by their own terms and privacy policies.
WebpageIQ does not control and is not responsible for:
- Third-party availability;
- Third-party security;
- Third-party data practices;
- Third-party pricing;
- Third-party changes;
- Third-party content;
- Third-party account restrictions;
- Third-party outages; or
- Third-party termination.
WebpageIQ may change or discontinue an integration if the third party changes its service, pricing, access, terms, or technology.
26. Feedback
You may provide ideas, suggestions, recommendations, requests, comments, or other feedback concerning WebpageIQ.
You grant WebpageIQ a perpetual, worldwide, irrevocable, royalty-free, transferable, sublicensable right to use, reproduce, modify, develop, commercialize, and incorporate feedback into the Services without compensation or attribution.
This section does not transfer ownership of your Customer Content or restrict your right to publish an honest review.
27. Reviews and Testimonials
You may publish honest reviews and opinions about WebpageIQ.
Nothing in these Terms prohibits or penalizes:
- An honest consumer review;
- A truthful performance assessment;
- A lawful complaint;
- A report to a regulator;
- A report to law enforcement; or
- A legally protected communication.
You may not publish content that is:
- Knowingly false;
- Defamatory;
- Unlawfully threatening;
- Harassing;
- Infringing;
- Confidential in violation of a legal duty;
- Fraudulent; or
- Otherwise unlawful.
WebpageIQ may ask permission to use a review, testimonial, business name, logo, or case study in marketing. WebpageIQ will not claim your endorsement without authorization.
28. Copyright Complaints and Repeat Infringers
WebpageIQ respects intellectual-property rights.
If you believe content hosted through WebpageIQ infringes your copyright, send a written notice to:

A copyright notice should include:
- Identification of the copyrighted work claimed to have been infringed;

- A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner; and
- Your physical or electronic signature.
WebpageIQ may:
- Remove or disable access to disputed content;
- Notify the affected customer;
- Request additional information;
- Restore content following a valid counter-notification;
- Terminate repeat infringers; and
- Take other actions permitted by law.
Customers whose content is removed may submit a counter-notification containing the information required by applicable copyright law.
WebpageIQ maintains a policy of terminating, in appropriate circumstances, users who repeatedly infringe intellectual-property rights.
The contact information in this section does not represent that WebpageIQ has completed any registration required to receive a particular statutory safe harbor. WebpageIQ may separately register a designated agent with the U.S. Copyright Office.
29. Confidentiality
Each party may receive nonpublic information from the other that a reasonable person would understand to be confidential.
Confidential information does not include information that:
- Is publicly available without breach;
- Was already lawfully known;
- Is received lawfully from another source without confidentiality obligations;
- Is independently developed without use of confidential information; or
- Must be disclosed by law.
Each party will use reasonable measures to protect the other party’s confidential information and use it only for purposes related to the Services.
WebpageIQ may disclose confidential information to employees, contractors, service providers, professional advisers, and agents who need it and are subject to appropriate obligations.
Nothing in this section prevents WebpageIQ from using aggregated or deidentified information as permitted by the Privacy Policy.
30. Service Availability and Changes
WebpageIQ aims to provide reliable Services but does not guarantee uninterrupted availability.
The Services may be unavailable because of:
- Maintenance;
- Updates;
- Security work;
- Software errors;
- Hardware failures;
- Network failures;
- Third-party outages;
- Domain or DNS issues;
- Content-delivery failures;
- Cyberattacks;
- Natural disasters;
- Government action;
- Labor disruptions;
- Utility failures; or
- Events beyond WebpageIQ’s reasonable control.
WebpageIQ may:
- Modify features;
- Improve interfaces;
- Replace technology;
- Change technical requirements;
- Update limits;
- Remove obsolete functionality;
- Discontinue integrations;
- Change plan structures; or
- Discontinue part or all of the Services.
For a material discontinuation affecting a paid plan, WebpageIQ will provide reasonable notice when practicable.
If WebpageIQ permanently discontinues a prepaid Service without offering a reasonably comparable replacement, WebpageIQ may provide a prorated refund for the unused prepaid period.
31. Backups and Data Loss
WebpageIQ may maintain backups for disaster recovery and operational continuity.
Backups are not a substitute for your own records.
You are responsible for retaining independent copies of important:
- Website content;
- Images;
- Logos;
- Form submissions;
- Customer records;
- Domain credentials;
- Business documents; and
- Other information.
WebpageIQ does not guarantee that:
- Every item is backed up;
- Every backup is current;
- Deleted content can be restored;
- Expired previews can be recovered;
- Suspended websites can be recreated exactly; or
- Historical analytics will remain available forever.
To the maximum extent permitted by law, WebpageIQ is not liable for data loss that could have been avoided through reasonable customer backups, except to the extent directly caused by WebpageIQ’s gross negligence, willful misconduct, or other liability that cannot lawfully be excluded.
32. Beta and Experimental Features
WebpageIQ may identify certain features as:
- Beta;
- Preview;
- Experimental;
- Early access;
- Pilot;
- Test; or
- Similar terminology.
These features may:
- Be incomplete;
- Contain errors;
- Change without notice;
- Produce unreliable results;
- Have limited support;
- Be discontinued;
- Lose data; or
- Operate differently from final features.
You use experimental features at your own risk.
WebpageIQ may limit or revoke access to them at any time.
33. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WEBPAGEIQ DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- TITLE;
- NON-INFRINGEMENT;
- ACCURACY;
- AVAILABILITY;
- RELIABILITY;
- SECURITY;
- QUIET ENJOYMENT; AND
- RESULTS.
WEBPAGEIQ DOES NOT WARRANT THAT:
- THE SERVICES WILL BE UNINTERRUPTED;
- THE SERVICES WILL BE ERROR-FREE;
- EVERY DEFECT WILL BE CORRECTED;
- CUSTOMER CONTENT WILL NEVER BE LOST;
- A WEBSITE WILL GENERATE SALES OR LEADS;
- A WEBSITE WILL ACHIEVE ANY SEARCH RANKING;
- ANALYTICS WILL BE COMPLETE OR EXACT;
- RECOMMENDATIONS WILL IMPROVE PERFORMANCE;
- GENERATED CONTENT WILL BE ACCURATE OR UNIQUE;
- THIRD-PARTY SERVICES WILL REMAIN AVAILABLE;
- THE SERVICES WILL SATISFY EVERY LAW OR INDUSTRY REQUIREMENT; OR
- THE SERVICES WILL BE IMMUNE FROM UNAUTHORIZED ACCESS OR CYBERATTACK.
YOU ARE RESPONSIBLE FOR DETERMINING WHETHER THE SERVICES ARE APPROPRIATE FOR YOUR BUSINESS AND LEGAL REQUIREMENTS.

34. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBPAGEIQ AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR:
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- SPECIAL DAMAGES;
- EXEMPLARY DAMAGES;
- PUNITIVE DAMAGES;
- CONSEQUENTIAL DAMAGES;
- LOST PROFITS;
- LOST REVENUE;
- LOST BUSINESS;
- LOST CUSTOMERS;
- LOST OPPORTUNITIES;
- LOSS OF GOODWILL;
- LOSS OF DATA;
- BUSINESS INTERRUPTION;
- COST OF SUBSTITUTE SERVICES; OR
- DAMAGES ARISING FROM THIRD-PARTY CLAIMS,
EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF WEBPAGEIQ AND THE OTHER COVERED PARTIES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO WEBPAGEIQ FOR THE AFFECTED SERVICE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
- $100.
This limitation applies collectively to all claims, regardless of legal theory, including:
- Contract;
- Tort;
- Negligence;
- Strict liability;
- Statute;
- Misrepresentation;
- Restitution; or
- Any other theory.
The limitations do not apply to liability that cannot legally be limited, which may include liability for:
- Fraud;
- Willful misconduct;
- Gross negligence;
- Death or personal injury caused by legally actionable conduct;
- Certain statutory rights; or
- Other nonwaivable liability.
The parties agree that the prices charged for the Services reflect this allocation of risk.
35. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless WebpageIQ and its owners, members, officers, employees, contractors, agents, affiliates, licensors, and service providers from claims, demands, proceedings, damages, judgments, liabilities, losses, costs, and reasonable attorneys’ fees arising out of or relating to:
- Your Customer Content;
- Your website;
- Your products or services;
- Your business practices;
- Your use of visitor or form information;
- Your violation of law;
- Your violation of these Terms;
- Your infringement of intellectual-property rights;
- Your violation of privacy or publicity rights;
- Your advertising claims;
- Your promises to customers;
- Your negligence or misconduct;
- Activities of your authorized users; or
- A dispute between you and your customer, visitor, employee, contractor, or third party.
WebpageIQ will:
- Provide reasonable notice of an indemnified claim;
- Allow you to control the defense where appropriate; and
- Provide reasonable cooperation at your expense.
You may not settle a claim in a manner that:
- Admits wrongdoing by WebpageIQ;
- Imposes an obligation on WebpageIQ;
- Restricts WebpageIQ; or
- Fails to fully release WebpageIQ
without WebpageIQ’s written consent.
WebpageIQ may participate in the defense with counsel of its choice at its own expense.
36. Disputes Between Customers and Third Parties
WebpageIQ is not a party to transactions between:
- A customer and a website visitor;
- A customer and its client;
- A customer and a vendor;
- A customer and an employee;
- A customer and a contractor;
- A customer and a domain registrar; or
- A customer and another third party.
You are responsible for resolving disputes concerning:
- Your goods or services;
- Pricing;
- Refunds;
- Appointments;
- Deliverables;
- Customer service;
- Form submissions;
- Marketing consent;
- Copyright ownership;
- Business representations; and
- Other matters arising from your business.
WebpageIQ may provide technical records where lawful and appropriate but is not required to mediate third-party disputes.
37. Governing Law
These Terms and disputes arising from them are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
To the extent federal law applies, federal law governs the applicable issue.
38. Venue and Jurisdiction
Except where applicable law requires otherwise, any legal action arising out of or relating to these Terms or the Services must be brought exclusively in:
- The state courts located in Madison County, Nebraska; or
- The United States District Court for the District of Nebraska.
Each party consents to the personal jurisdiction and venue of those courts.
Nothing prevents either party from:
- Seeking temporary or emergency injunctive relief;
- Bringing an eligible matter in small-claims court;
- Enforcing intellectual-property rights; or
- Pursuing remedies in another forum where exclusive venue cannot lawfully be required.
39. Informal Dispute Resolution
Before filing a lawsuit, the complaining party must provide written notice describing:
- The party’s name and contact information;
- The account or website involved;
- The facts giving rise to the dispute;
- The legal or contractual basis of the claim;
- The requested resolution; and
- Supporting documents reasonably available.
Notices to WebpageIQ must be sent to:
The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice.
This section does not prevent emergency relief, preserve-expiring claims, small-claims actions, or actions where pre-suit notice is prohibited by law.
40. Time Limit for Claims
To the maximum extent permitted by law, any claim arising out of or relating to the Services or these Terms must be filed within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim.
Claims not filed within that period are permanently barred.
This limitation does not apply where applicable law prohibits shortening the limitations period.
41. Changes to These Terms
WebpageIQ may update these Terms to reflect changes in:
- The Services;
- Pricing structures;
- Features;
- Security practices;
- Business operations;
- Third-party services;
- Legal requirements; or
- Risk management.
WebpageIQ will update the “Last Updated” date when the Terms change.
For material changes, WebpageIQ may provide notice through:
- Email;
- The account portal;
- A login screen;
- A website banner;
- An in-product message; or
- Another reasonable method.
WebpageIQ may require you to affirmatively accept material updated Terms.
Changes generally apply prospectively from their stated effective date.
Continuing to use the Services after the effective date of updated Terms constitutes acceptance when permitted by law and when reasonable notice has been provided.
A change does not retroactively alter an existing dispute unless both parties agree.
42. Assignment
You may not assign or transfer these Terms, your account, or your rights under the Services without WebpageIQ’s prior written consent.
WebpageIQ may assign these Terms in connection with:
- A merger;
- Acquisition;
- Reorganization;
- Sale of assets;
- Financing;
- Corporate restructuring; or
- Transfer of the Services.
Any attempted assignment that violates this section is void.
43. Force Majeure
WebpageIQ is not responsible for delay or failure caused by events beyond its reasonable control, including:
- Natural disasters;
- Severe weather;
- Fire;
- Flood;
- War;
- Terrorism;
- Civil unrest;
- Epidemics;
- Labor disputes;
- Utility failures;
- Internet failures;
- Cloud-service failures;
- Domain-system failures;
- Cyberattacks;
- Government action;
- Changes in law;
- Third-party platform failures; or
- Supply shortages.
This section does not excuse payment obligations for Services already provided.
44. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable:
- The provision will be enforced to the maximum extent permitted;
- The remaining provisions will remain in effect; and
- The invalid provision will be modified only as much as necessary to make it enforceable where permitted.
45. Waiver
A failure or delay in enforcing a provision is not a waiver.
A waiver is effective only if it is in writing and signed or electronically confirmed by the party granting it.
A waiver on one occasion does not waive future enforcement.
46. No Third-Party Beneficiaries
These Terms do not create rights for any person or entity other than you and WebpageIQ, except that WebpageIQ’s owners, employees, contractors, affiliates, licensors, and service providers may enforce provisions expressly protecting them.
47. Relationship of the Parties
You and WebpageIQ are independent contracting parties.
These Terms do not create:
- An employment relationship;
- Partnership;
- Joint venture;
- Franchise;
- Fiduciary relationship;
- Agency relationship; or
- Exclusive relationship.
Neither party may bind the other except as expressly authorized.
48. Order of Precedence
If these Terms conflict with another written agreement signed by WebpageIQ, the signed agreement controls for the specific subject matter it addresses.
Otherwise, the following order applies:
- A written order form or statement of work accepted by both parties;
- Offer-specific written terms;
- These Terms;
- The applicable pricing or checkout disclosures;
- Product documentation; and
- General marketing materials.
The Privacy Policy controls specifically regarding WebpageIQ’s collection, use, disclosure, and retention of personal information.
49. Entire Agreement
These Terms, the Privacy Policy, applicable checkout disclosures, accepted order forms, offer-specific terms, and incorporated policies constitute the entire agreement concerning the Services.
They replace prior oral or written understandings concerning the same subject matter.
Statements by salespeople, support personnel, contractors, or other representatives do not modify these Terms unless confirmed in an authorized written agreement.
50. Survival
Provisions that by their nature should continue after termination will survive, including provisions concerning:
- Payment obligations;
- Ownership;
- Customer Content licenses as necessary for deletion and backups;
- Intellectual property;
- Confidentiality;
- Disclaimers;
- Limitations of liability;
- Indemnification;
- Disputes;
- Governing law;
- Venue;
- Data retention;
- Copyright complaints; and
- General contractual interpretation.

52. Acceptance
By checking the acceptance box, creating an account, purchasing a subscription, or using the Services, you acknowledge that:
- You have read these Terms;
- You understand these Terms;
- You agree to be bound by these Terms;
- You have authority to accept them;
- Paid subscriptions renew automatically until canceled;
- You understand the applicable price and billing frequency;
- You understand how to cancel;
- You have reviewed the Privacy Policy; and
- Electronic acceptance has the same effect as signing a written agreement.
